These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and Grocsmart (“Company”, “we”, “us”, “our”) governing your access to and use of the Grocsmart mobile application, website, and related services (collectively, the “Platform”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.
“Platform” means the Grocsmart mobile application, website, and services.
“User” means any individual who accesses or uses the Platform.
“Seller” means third-party grocery stores or vendors listed on the Platform.
“Order” means a request placed by a User for products through the Platform.
You represent and warrant that:
You are at least 18 years of age
You have the legal capacity to enter into a binding contract
All information provided by you is true, accurate, and complete
3.1 You may be required to create an account to use certain features.
3.2 You are solely responsible for safeguarding your login credentials.
3.3 Grocsmart shall not be liable for any loss or damage arising from unauthorized account use.
3.4 We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
Grocsmart operates as a technology platform that facilitates the purchase and delivery of grocery, food, pharmacy etc products from third-party Sellers. Grocsmart does not manufacture, store, or directly sell grocery products unless expressly stated.
5.1 Prices, availability, and product descriptions are displayed on the Platform and may change without notice.
5.2 An Order is confirmed only upon successful payment.
5.3 We reserve the right to cancel or reject Orders due to:
Product unavailability
Pricing or technical errors
Suspected fraudulent activity
6.1 Delivery times provided are estimates only and not guaranteed.
6.2 Delays may occur due to traffic, weather, or operational issues.
6.3 The User must ensure availability at the delivery address. Failed deliveries may result in additional charges.
7.1 Orders may be canceled prior to dispatch, subject to our Cancellation Policy.
7.2 Refund eligibility depends on product type, condition, and Seller policies.
7.3 Refunds, if approved, will be processed within 7 business days to the original payment method.
8.1 Product images and descriptions are for reference purposes only.
8.2 Grocsmart does not warrant the quality, freshness, or suitability of products supplied by Sellers.
8.3 Responsibility for product compliance rests with the respective Seller.
You agree not to:
Use the Platform for unlawful or fraudulent purposes
Provide false or misleading information
Harass, abuse, or threaten Sellers, delivery personnel, or staff
Interfere with the security or functionality of the Platform
All content, software, logos, trademarks, and designs on the Platform are the exclusive property of Grocsmart and are protected by applicable intellectual property laws. Unauthorized use is strictly prohibited.
Your use of the Platform is subject to our Privacy Policy, which forms an integral part of these Terms.
To the maximum extent permitted by law:
Grocsmart shall not be liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed the amount paid by the User for the relevant Order.
You agree to indemnify and hold harmless Grocsmart, its directors, employees, and partners from any claims, damages, or expenses arising out of your misuse of the Platform or violation of these Terms.
The Platform may contain links or integrations with third-party services. Grocsmart does not control and is not responsible for third-party content, policies, or actions.
We reserve the right to suspend or terminate access to the Platform at our sole discretion, with or without notice, if you breach these Terms.
These Terms shall be governed by and construed in accordance with the laws of Assam, and courts located therein shall have exclusive jurisdiction.
We may modify these Terms at any time. Continued use of the Platform following updates constitutes acceptance of the revised Terms.
